Rules and Regulations
I. Aims and Background
CineLink Work in Progress is an annual project of the Sarajevo Film Festival dedicated to promoting feature-length films in post-production phase with potential for theatrical distribution Albania, Austria, Bosnia and Herzegovina, Bulgaria, Caucasus Region, Croatia, Cyprus, Greece, Hungary, Macedonia, Malta, Middle East, Montenegro, North Africa, Romania, Serbia, Slovenia, Turkey and UNMI Kosovo (in further text: the Region).
II. The Subject of project CineLink
Project CineLink Work in Progress provides various means of support for finalizing and promotio of feature-length fiction films from the Region which hold potential for further theatrical distribution and which are classified as film projects in post-production (in further text: Film Projects).
In order for a Film Project to qualify for admission to CineLink Work in Progress project in regard to these Regulations, it has to meet all of the following conditions:
• Feature-length film with potential for theatrical distribution;
• Which already has an appointed delegate producer and a director;
• Which is in any of the stages of post-production;
• For which there is a potential regional or international market.
III. Applicants
All filmmakers from the Region hold the right to apply to CineLink project.
Filmmakers stated in the previous Paragraph (in further text: Applicants), in relation to these Regulations are classified as Legal Persons or Natural Persons that hold creative and financial control over relevant Film Projects.
III.1 Chain of Title
In case the Applicant is a producer or a production house he/she has to possess the necessary authorization from the author of the film project in order to be able to represent them.
In case the film project has numerous producers they amongst themselves have to elect one producer that will serve as the Applicant in regard to these regulations and will represent them in relations with CineLink.
In case the Applicant is the author of the film project, and it is a case of a project Co-authorship, the Applicant is required to possess settled property relations over the film project as well as an authorization of representation from the other authors.
The competent law for regulation of copyrights in relation to these Regulations is the Law on Copyright and Related Rights of Bosnia and Herzegovina ("Official Gazette of Bosnia and Herzegovina”, issues 7/02 and 32/02).
IV. Nature of Assistance
Project CineLink provides assistance and support both to upcoming and already affirmed authors and producers from the Region, which is offered in form of technical assistance, consulting, liaison, as well as with financial assistance.
IV.1. Financial Assistance consists of:
• CineLink Work in Progress Awards
Every year one Project from CineLink Work in Progress is rewarded with Post Republic Award, in kind postproduction services in amount of 80.000 Euro. In addition, one project will be awarded with Restart Award in kind support in amount of 20.000 Euro.
V. Procedure
The application must provide:
• Original title,
• English title,
• Director,
• Country,
• Production company,
• Total budget,
• Funding needed for completion,
• Delivery date,
• Production company contact details,
• Production company profile,
• Story outline (not more than 10 lines),
• Full Synopsis (not more than 500 words),
• Author’s statement (not more than 400 words),
• Director’s contact details and biography/filmography,
• Producer’s contact details and biography/filmography,
• Rights availability,
• Information concerning financing parties or partners that are already involved with the project,
• the video files with at least 20min, of rough cut of the film to be uploaded by the applicant on an online video platform with secure access (eg VIMEO) . Username, Password and the link to be sent together with the application form via email : wip@sff.ba.

V.1. Preliminary Proceedings and Projects selection
After the period for Application submission has expired the CineLink Work in Progress Secretariat will begin considering all received Applications, and in case it is determined that an Application is in some form disorderly or the documentation incomplete the Secretariat will call upon the Applicant to refill the incomplete Application Form and a new and reasonable deadline will be issued for these proceedings.
In case the Applicant acts in accordance with the instructions issued by the CineLink Work in Progress Secretariat the application is to be considered as properly submitted.
In case the Applicant does not resubmit the Application within the additional time period the Application will be considered as not properly submitted and shall not be taken into consideration further.
Once having in possession all properly filled applications the CineLink Work in Progress Secretariat will deliver all Applications that were received within the stipulated time-frames to the Selection Committee that will select around 5 projects, which will participate in the CineLink Work in Progress presentation during CineLink Co-production Market.
The Selection Committee has a total of 5 members which are appointed by the “Obala Art Centar” Management.
The selection and precise number of projects that will partake in the CineLink Work in Progress depends exclusively on the discreet evaluation made by the Selection Committee.
V.2. Awards Selection
CineLink Work in Progress Jury has a total of 3 members.
Jury members’ names will be published before the CineLink Co-Production Market.
By participating at the CineLink Work in Progress during CineLink Co-Production Market, the Applicant agrees that the Jury composed as previously stated will adjudicate in matters concerning the Application and that the Applicant renounces the right for further appeal.
With the conclusion of consultations with all the representatives from every one of the projects the CineLink Work in Progress Jury will select 2 projects which will be awarded with Postr Republic and Restart awards.
V.3. General Provisions
The Selection Committee and the Main Jury will reach decision concerning projects involved in CineLink project for the current year on basis of their subjective professional evaluation.
By submitting an Application the Applicant confirms the indisputability of the Selection Committee members’ authority and professionalism and therefore the Applicant renounces the right to dispute about the professional evaluation of the Jury.
VI. Applicant’s Obligations
VI.1. Applicant’s Obligations during the Production Stage
Each Applicant that gets chosen to participate in the CineLink Work in Progress project is required to cooperate with the employees and persons of responsibility of the CineLink Work in Progress project during the entire course, and in all respective phases of the CineLink project.
The Applicant is required to ensure that at least 1 representative of their Film Project will attend CineLink Work in Progress during the CineLink Coproduction Market.
VI.2. Applicant’s Obligations after the completion of the Film Project
The Applicant guaranties the following:
a) The Film shall have a CineLink logo accompanied by the following text in English either during the opening or the closing credits: “Developed in cooperation with CineLink Work in Progress - Sarajevo Film Festival”
b) The international premiere of the film should first be offered to Sarajevo Film Festival - this is in case the film was not already invited to one of the competition programs of the festivals in Cannes, Berlin, Venice or Rotterdam.
c) The producer will provide the CineLink Secretariat with regular reports concerning the accomplishments of the film which are to be delivered every 3 months.
d) Upon the completion of the film the producer will provide the CineLink Secretariat with two DVDs with English subtitles.
e) The producer will provide the CineLink Secretariat with regular reports concerning the film’s festival representation and distribution.
f) The producer will provide the CineLink secretariat with regular reports with critics’ opinions and newspaper articles concerning the film.
Applicants whose Film Projects are selected to receive a cash award, in-kind award and scholarship specified in Article V.2. of these Regulations guarantee that:
a) The film shall have a CineLink logo accompanied by the following text in English either during the opening or the closing credits, on the official poster of the film, as well as in every paid advertisement that are purchased or are found under the control of the producer that is related to the film: “Developed in cooperation with CineLink Work in Progress - Sarajevo Film Festival”
VII. Contract, Copyrights and Property Rights
In the case of suspensive condition realization, Obala Art Centar will receive distribution rights for the film without a fee, in all free, previously stated territories for the duration of 10 years, about which a contract will be concluded upon the expiration of the previously stated 6 month period.
The distribution rights stated in the previous Paragraph incorporate all exclusive and by no means limited rights concerning reproduction, placement into circulation, public screenings, titling, dubbing and broadcasting of the Film Project in regard to Articles 80. and 81. of the Law on Copyright and Related Rights of Bosnia and Herzegovina (“Official Gazette of Bosnia and Herzegovina”, issue 7/02).
In case of transition of distribution rights from the Applicant to Obala Art Centar this right also incorporates the right to give this right as a sublicense to third parties without the need for any other approval or consent from the Applicant and other authors of the Film Project.
VIII. Transitional and Final Provisions
The official language of the CineLink Work in Progress project is English.
In regard to all matters not expressly settled by these Regulations good business practices and current regulations of Bosnia and Herzegovina and its entities are to be applied.
Any amendments and supplements to these Regulations are valid only if submitted in written form.
By submitting the application the Applicant agrees to all provisions of these Regulations.
These Regulations come into effect from the day of their publishing on the Sarajevo Film Festival official webpage www.sff.ba, and are effective beginning on the 1st of January, 2012.
